Section 35-12-42Claims for property or proceeds of sale — Judicial review.
Any person aggrieved by a decision of the Treasurer or as to whose claim the Treasurer has failed to act within 90 days after the filing of the claim may commence a civil action for a declaratory judgment against the Treasurer in the Circuit Court of Montgomery County, Alabama, or in the circuit court of the county in Alabama of residence of the person aggrieved, to determine or establish the claimant's rights. The proceeding shall be brought within 90 days after the decision of the Treasurer or within 180 days from the filing of the claim if the Treasurer fails to act. The action shall be tried de novo without a jury.
